-webkit-tap-highlight-color: transparent; outline: 0px; max-width: 100%; visibility: visible; box-sizing: border-box !important;'><span textstyle='' style='letter-spacing: 2px;'>第09版：地方视窗</span></span></p><p><span leaf=""><br></span></p><p style='line-height: 1.75em;text-align: justify;'><span leaf=""> “加处的罚款不用交了，感谢检察机关帮我们渡过难关。”近日，在湖北省仙桃市检察院举行的一场听证会上，经营早餐店的个体工商户王某某和彭某某紧握着检察官的手，激动之情溢于言表。一次看似已经“板上钉钉”的行政处罚，在检察机关的介入下，出现了转机。</span></p><p style='line-height: 1.75em;text-align: justify;'><span leaf=""> 2024年9月，王某某与彭某某在制作早餐过程中，因超限量使用食品添加剂，分别被仙桃市市场监督管理局处以1万元和5000元罚款。由于二人法律意识欠缺，他们既未在法定期限内申请行政复议，也未提起行政诉讼，逾期未缴纳罚款。加上加处罚款，罚款累计金额分别为2万元和1万元，在多次催告无果后，市场监督管理局向法院申请强制执行。</span></p><p style='line-height: 1.75em;text-align: justify;'><span leaf=""> 今年8月，仙桃市检察院在开展涉市场主体行政执行专项监督活动中，发现了这两起案件。个体工商户是市场经济的“毛细血管”，其生存状态直接关系到民生福祉与市场活力，绝不能简单“就案办案”。随后，检察官主动走进二人经营的早餐店开展实地调查：狭小的操作间里厨具整齐排列，紧邻的生活区仅能容纳一张小床，全家的生活开支全靠早餐店微薄的收入支撑。</span></p><p style='line-height: 1.75em;text-align: justify;'><span leaf=""> 为进一步查清案件事实、化解行政争议，检察机关与仙桃市市场监督管理局开展专题座谈，就案件事实、法律适用及执行情况进行全面核查。经查，市场监督管理局的行政处罚事实清楚、证据确凿、程序合法，法院的执行程序亦无不当。如何在维护食品安全监管权威与帮助市场主体纾困解难之间找到平衡点，成为化解争议的关键。随后，该院决定启动检察听证程序，搭建行政机关与当事人之间的沟通桥梁。</span></p><p style='line-height: 1.75em;text-align: justify;'><span leaf=""> 听证会上，检察官围绕处罚依据、加处罚款的法律规定进行释法说理，明确指出超量使用食品添加剂的违法性及食品安全监管的重要意义，并客观陈述了两位经营者的经营困境与家庭实际情况。听证员经评议认为，当事人违法情节较轻且无主观恶意，确因客观困难导致逾期缴费，可以免除加处罚款。</span></p><p style='line-height: 1.75em;'><span leaf=""> 在检察机关的协调推动下，市场监督管理局综合考量当事人的认错态度、经营现状及家庭困难，最终作出免除加处罚款的决定。“我们知道错了，今后一定严格遵守食品安全规定，诚信经营！”行政争议圆满化解，王某某和彭某某深受触动，并于听证会后缴清了1万元和5000元罚款。</span></p><p style='line-height: 1.75em;text-align: justify;'><span leaf=""> 这起案件的妥善处理，是检察机关以听证促进行政争议实质性化解的生动实践。该院以“看得见、听得懂”的方式让当事人了解到法律的威严，更感受到了司法的温暖，有效实现“案结事了、定分止争”的办案目标。</span></p><section data-tools="135编辑器" data-id="97706" data-pm-slice="0 0 []" style='-webkit-tap-highlight-color: transparent;
